Welcome to Virginia & Rook. These Terms of Use (“Terms”) set out the rules for using the Virginia & Rook website at www.virginiarook.com (the “Site”) and for shopping with us online, by phone, or in connection with our products and services.

Virginia & Rook is a customer-facing business operated by Vishnu Incorporated (“we,” “us,” or “our”). By accessing or using the Site, or by placing an order, you agree to these Terms. If you do not agree, please do not use the Site or place an order.

These Terms should be read together with our Privacy Policy, Payment Methods, and Shipping & Returns pages.

Who these Terms apply to

In these Terms:

• “You” and “your” mean the person visiting the Site or placing an order
• “We,” “us,” and “our” mean Virginia & Rook and Vishnu Incorporated

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply in Ontario, unless mandatory consumer-protection laws in your province or territory provide otherwise.

Eligibility and accounts

Virginia & Rook is a general retail store for all ages. Some products, including smoking-related merchandise, may be age-restricted. You are responsible for making sure you are allowed to buy the products you order. We do not set one store-wide legal purchase age on this Site.

If you create an account, you are responsible for keeping your login details confidential and for activity under your account. Please Contact Us right away if you think your account has been used without permission.

Online orders and consumer information

Placing an order is a request to purchase the products in your cart at the prices, taxes, shipping charges, and other amounts shown before you confirm payment. We may check availability and payment before we fulfil the order.

Before you complete checkout, please review your order carefully. Checkout is designed to give you a chance to check product details, quantities, shipping choices, payment method, and totals, and to correct errors before you confirm the purchase.

After you place an order, we will send order confirmation and related transactional emails. Please keep those emails for your records. For Ontario consumers and other applicable Canadian consumer transactions, we aim to provide the information required for internet agreements under applicable consumer-protection law, including a copy or confirmation you can retain.

Prices are generally shown in Canadian dollars (CAD) unless otherwise stated. Taxes, shipping, and discounts are calculated at checkout and may depend on your shipping address and any coupon you apply.

We may refuse, cancel, or limit an order if a product is unavailable, pricing or inventory information is incorrect, payment cannot be processed, fraud is suspected, or shipping to your address is not available.

Products, descriptions, and availability

We aim to describe products fairly and accurately. Product photos, colours, scents, sizes, and packaging can vary slightly from what appears on screen. Fragrance, wellness, spiritual, essential-oil, and self-care products are sold for personal use as described on the product page; results can vary from person to person.

We do not make unsupported health or supernatural guarantees. No guarantees are given or implied about product efficiency, performance, production, or improvement beyond what is required by applicable law or expressly stated by us in writing. Nothing in these Terms removes rights that applicable consumer-protection law does not allow us to waive.

Unavailable products

If an ordered product becomes unavailable, we email you and may present available options. We do not automatically substitute another item. If a substitution is offered, it is only shipped if you choose it.

If we do not hear back within 24 hours, the order is cancelled, a full refund is issued to the original payment method, and a follow-up email explains the cancellation.

Payments

Accepted payment methods may include Visa, Mastercard, American Express, Discover, PayPal, Apple Pay, Google Pay, Klarna, Affirm, Afterpay, and Interac e-Transfer for Canadian bank accounts, as described on our Payment Methods page. Availability can vary by device, location, order, eligibility, and checkout configuration. We do not promise that every method will appear for every customer.

Card, wallet, and financing payments are processed by Stripe. PayPal payments are processed by PayPal.

You agree to provide accurate billing information and to pay all amounts due for your order. Payment processors may display Virginia & Rook or, for some PayPal payments, Vishnu Incorporated (VINC) on statements.

Shipping, customs, and returns

Shipping, delivery estimates, free-shipping rules, packaging, returns, and refunds are described in our Shipping & Returns policy, which forms part of your purchase experience with us.

We ship from London, Ontario across Canada and internationally, except the United States. We currently do not ship to the United States. Typical processing is 24–48 hours, depending on the product. Every shipped order receives tracking. Typical carriers include Canada Post, UPS, Purolator, and FedEx; the carrier for a given order depends on destination and service. P.O. boxes are accepted, though not every carrier can serve every destination or P.O. box.

Free shipping is available on qualifying orders of $49 or more after coupons and discounts are applied. This offer applies to Canadian orders. International orders are not included.

For international orders outside Canada, you are responsible for knowing whether your destination allows the products you order to be imported by mail, and for any duties, taxes, or customs charges. Some products have destination restrictions.

If a parcel is lost, delayed, or damaged in transit, we contact the carrier and start an investigation. After that investigation, an order may be reshipped depending on the outcome and stock availability.

Defective, incorrect, or damaged items. Email orders@virginiarook.com first with your name, order number, order date, and an explanation of the problem. A return must be approved before you send it. If approved, Virginia & Rook supplies the return shipping label. After we receive and verify the returned item, we send a replacement, subject to availability.

Unused and unopened returns. Eligible unused and unopened products may be returned within 30 days of the date you receive the order. Please contact us before returning the item. The customer pays return postage. Guest orders are eligible. Once an approved unused and unopened return is received and inspected, the refund is issued to the original payment method. Depending on your bank or payment provider, it may take 7–10 business days for the credit to appear.

Opened or used items. Opened or used personal-care, spiritual, fragrance, oil, candle, clothing, and similar hygiene or use-sensitive products are not returnable once opened or used.

Missing items. If an order arrives with an item missing, email orders@virginiarook.com. We perform an internal investigation, including checking inventory levels. If the missing item is verified, we send that product. No return is required, because the item was never received.

These store policies do not remove rights that applicable consumer-protection law does not allow us to waive.

• Break any applicable law

• Interfere with Site security, performance, or other users
• Upload malware or harmful code

Linking to our Site

You may link to our home page or other public pages in a fair and legal way that does not damage our reputation or suggest endorsement where none exists.

Government agencies, search engines, news organizations, and similar directory or information services may link without prior written approval if the link is not misleading and does not falsely imply sponsorship.

Other organizations may request permission by emailing contact@virginiarook.com. Include your organization details, contact information, the URLs you want to link from, and the pages on our Site you want to link to. Please allow 2–3 weeks for a response.

Approved links may use our corporate name, the URL being linked to, or another accurate description. You may not use our logo or artwork for linking without a trademark licence. You may not frame our pages or alter the Site’s appearance without prior written permission.

We may ask you to remove links at any time, and you agree to do so promptly.

Third-party sites and content

The Site may contain links to third-party websites. We are not responsible for their content, policies, or practices. Following a third-party link is at your own risk.

If you link to us from your own site, you are responsible for that site’s content. Links must not appear alongside content that is libellous, obscene, criminal, or that infringes third-party rights.

Disclaimers

To the maximum extent permitted by applicable law, we exclude representations, warranties, and conditions relating to the Site and its use, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, except where such exclusions are not allowed.

Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law, including liability for fraud or fraudulent misrepresentation, or liability that consumer-protection statutes do not allow us to exclude.

We try to keep Site information accurate and the Site available, but we do not warrant that the Site will always be uninterrupted, error-free, or fully up to date.

Limitation of liability

To the maximum extent permitted by applicable law, Virginia & Rook and Vishnu Incorporated are not liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising out of or connected with your use of the Site or the use or misuse of products sold, even if we have been advised of the possibility of such damages.

Where liability cannot be excluded, our total liability related to any order or Site use is limited to the amount you paid for the products giving rise to the claim, except where applicable law requires otherwise.

These limits do not affect rights you may have as a consumer under Ontario’s Consumer Protection Act, 2002, or other mandatory Canadian consumer-protection laws that cannot be waived.

Indemnity

To the extent permitted by law, you agree to indemnify and hold harmless Virginia & Rook and Vishnu Incorporated from claims arising out of your misuse of the Site, your Comments, or your breach of these Terms, except to the extent caused by our negligence or wilful misconduct.

Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date at the top of this page. Material changes may also be noted on the Site.

Updated Terms apply to later use of the Site and to later orders. They do not retroactively change the terms that applied to a purchase you already completed, except where applicable law requires or allows a different result.

Continued use of the Site after an update means you accept the revised Terms for that later use, except where mandatory law requires a different process for consumer contracts.
