Welcome to Virginia & Rook. These Terms of Use (“Terms”) set out the rules for using the Virginia & Rook website at www.virginiarook.com (the “Site”) and for shopping with us online, by phone, or in connection with our products and services.
Virginia & Rook is a division of Vishnu Incorporated (“we,” “us,” or “our”). By accessing or using the Site, or by placing an order, you agree to these Terms. If you do not agree, please do not use the Site or place an order.
These Terms should be read together with our Privacy Policy, Payment Methods, and Shipping & Returns pages.
Who these Terms apply to
In these Terms:
- “You” and “your” mean the person visiting the Site or placing an order
- “We,” “us,” and “our” mean Virginia & Rook and Vishnu Incorporated
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply in Ontario, unless mandatory consumer-protection laws in your province or territory provide otherwise.
Eligibility and accounts
You must be at least the age of majority in your province or territory (or have a parent or legal guardian’s consent) to place an order.
If you create an account, you are responsible for keeping your login details confidential and for activity under your account. Please Contact Us right away if you think your account has been used without permission.
Online orders and consumer information
When you buy from us online, you are entering into a consumer purchase agreement for the products in your cart at the prices, taxes, shipping charges, and other amounts shown before you confirm payment.
Before you complete checkout, please review your order carefully. Checkout is designed to give you a chance to check product details, quantities, shipping choices, payment method, and totals, and to correct errors before you confirm the purchase.
After you place an order, we will send order confirmation and related transactional emails. Please keep those emails for your records. For Ontario consumers and other applicable Canadian consumer transactions, we aim to provide the information required for internet agreements under applicable consumer-protection law, including a copy or confirmation you can retain.
Prices are generally shown in Canadian dollars (CAD) unless otherwise stated. Taxes, shipping, and discounts are calculated at checkout and may depend on your shipping address and any coupon you apply.
We may refuse, cancel, or limit an order if a product is unavailable, pricing or inventory information is incorrect, payment cannot be processed, fraud is suspected, or shipping to your address is not available.
Products, descriptions, and availability
We aim to describe products fairly and accurately. Product photos, colours, scents, sizes, and packaging can vary slightly from what appears on screen. Fragrance, wellness, spiritual, and self-care products are sold for personal use as described on the product page; results can vary from person to person.
No guarantees are given or implied about product efficiency, performance, production, or improvement beyond what is required by applicable law or expressly stated by us in writing.
Product substitutions
If the style or model you ordered is out of stock, we will email you. If we do not receive confirmation about a substitution within 24 hours, the closest substitution to what you ordered may be shipped, consistent with our Shipping & Returns policy.
Payments
Accepted payment methods may include Visa, Mastercard, American Express, Discover, PayPal, Apple Pay, Google Pay, Klarna, Affirm, Afterpay, and Interac e-Transfer for Canadian bank accounts, as described on our Payment Methods page. Availability can vary by device, location, and checkout options.
You agree to provide accurate billing information and to pay all amounts due for your order. Payment processors may display Virginia & Rook or, for some PayPal payments, Vishnu Incorporated (VINC) on statements.
Shipping, customs, and returns
Shipping, delivery estimates, free-shipping rules, packaging, returns, and refunds are described in our Shipping & Returns policy, which forms part of your purchase experience with us.
We ship from London, Ontario. Some destinations and products have restrictions. We currently do not ship to the United States. For international orders outside Canada (where available), you are responsible for knowing whether your country or destination allows the products you order to be imported by mail, and for any customs duties, taxes, or import requirements. Virginia & Rook is not responsible for destination-country customs restrictions outside Canada.
Privacy and cookies
Our collection and use of personal information is explained in our Privacy Policy. The Site uses cookies and similar technologies as described there. By using the Site, you acknowledge that notice.
Intellectual property
Unless otherwise stated, Virginia & Rook and/or its licensors own the intellectual property rights in the Site and its content, including text, images, logos, graphics, and design. All rights are reserved.
You may view and print pages from the Site for your own personal, non-commercial use, subject to these Terms.
You must not:
- Republish Site material without permission
- Sell, rent, or sublicense Site material
- Reproduce, duplicate, or copy Site material for commercial use
- Redistribute Site content unless it is specifically made for redistribution
User comments and submissions
Some parts of the Site may allow you to post comments, reviews, or other content (“Comments”). Comments reflect the views of the person who posts them, not Virginia & Rook.
We may monitor Comments and remove any content we consider inappropriate, offensive, unlawful, or otherwise in breach of these Terms. To the extent permitted by law, we are not responsible for Comments or for loss or damage arising from Comments.
If you post Comments, you represent that:
- You have the right to post them
- They do not infringe anyone else’s intellectual property or other rights
- They are not defamatory, obscene, harassing, unlawful, or an invasion of privacy
- They will not be used to solicit business or promote unlawful activity
You grant Virginia & Rook a non-exclusive, royalty-free licence to use, reproduce, edit, and authorize others to use and edit your Comments in any form or media.
Acceptable use
You agree not to use the Site to:
- Break any applicable law
- Attempt unauthorized access to the Site, accounts, or systems
- Interfere with Site security, performance, or other users
- Upload malware or harmful code
- Scrape or harvest data in a way that harms the Site or violates these Terms
- Misrepresent your identity or affiliation
We may suspend or terminate access if we reasonably believe these Terms have been breached.
Linking to our Site
You may link to our home page or other public pages in a fair and legal way that does not damage our reputation or suggest endorsement where none exists.
Government agencies, search engines, news organizations, and similar directory or information services may link without prior written approval if the link is not misleading and does not falsely imply sponsorship.
Other organizations may request permission by emailing contact@virginiarook.com. Include your organization details, contact information, the URLs you want to link from, and the pages on our Site you want to link to. Please allow 2–3 weeks for a response.
Approved links may use our corporate name, the URL being linked to, or another accurate description. You may not use our logo or artwork for linking without a trademark licence. You may not frame our pages or alter the Site’s appearance without prior written permission.
We may ask you to remove links at any time, and you agree to do so promptly.
Third-party sites and content
The Site may contain links to third-party websites. We are not responsible for their content, policies, or practices. Following a third-party link is at your own risk.
If you link to us from your own site, you are responsible for that site’s content. Links must not appear alongside content that is libellous, obscene, criminal, or that infringes third-party rights.
Disclaimers
To the maximum extent permitted by applicable law, we exclude representations, warranties, and conditions relating to the Site and its use, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, except where such exclusions are not allowed.
Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law, including liability for fraud or fraudulent misrepresentation, or liability that consumer-protection statutes do not allow us to exclude.
We try to keep Site information accurate and the Site available, but we do not warrant that the Site will always be uninterrupted, error-free, or fully up to date.
Limitation of liability
To the maximum extent permitted by applicable law, Virginia & Rook and Vishnu Incorporated are not liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising out of or connected with your use of the Site or the use or misuse of products sold, even if we have been advised of the possibility of such damages.
Where liability cannot be excluded, our total liability related to any order or Site use is limited to the amount you paid for the products giving rise to the claim, except where applicable law requires otherwise.
These limits do not affect rights you may have as a consumer under Ontario’s Consumer Protection Act, 2002, or other mandatory Canadian consumer-protection laws that cannot be waived.
Indemnity
To the extent permitted by law, you agree to indemnify and hold harmless Virginia & Rook and Vishnu Incorporated from claims arising out of your misuse of the Site, your Comments, or your breach of these Terms, except to the extent caused by our negligence or wilful misconduct.
Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date at the top of this page. Material changes may also be noted on the Site. Continued use of the Site after an update means you accept the revised Terms, except where mandatory law requires a different process for consumer contracts.
